Primarily directive and evaluative, although I use facilitative, non-directive techniques when appropriate. |
Arbitration Approach: |
For binding arbitration I apply the California Evidence Code and substantive law, unless the parties have agreed otherwise; that being said, I generally run a relatively informal hearing. I work closely with the parties to determine exactly how the hearing should be conducted. |
Neutral Approach: |
I like to guide the participants to a better understanding of the case by engaging the participants in a systematic analysis of the legal, factual, and practical aspects of their own case, as well as the other side's case. |
Other Information: |
I like to work with counsel before any hearing or session so that everyone is clear as to the form and nature of the ADR process in which they are about to engage. When appropriate, I also like to do a fair amount of case "work-up" beforehand, so that we can hit the ground running when the session begins. |
