| Mediation Approach: |
I use both a facilitative/nondirective and evaluative/directive approach, sometimes within the same mediation, as I see opportunities to settle the dispute. |
| Arbitration Approach: |
I handle arbitration like a "mini trial". Depending on the requests of counsel and the scope of the dispute, I can make adjustments to increase/decrease the formality of the proceedings. |
| Neutral Approach: |
As of April 2008, I have not had the opportunity to serve a a neutral evluator. |

In 2007, I was featured on the front page of The Recorder for the $96 million cash settlement of Smokless Tobacco antitrust cases, which involved anti-competitive practices and Sherman anti-trust violantions. The settlement resolved claims that US Tobacco engaged in "extensive restrictive and exclusionary acts" to eliminate competition for moist snuff. I have drawn upon my past experience as the Presiding Judge of the San Francisco Probate Court to mediate numerous contentious probate and trust cases. Over 25% of my caseload involves mediations of these disputes, often involving signifcant estates. The settlements reached have involved the distribution of over $100 million worth of land and other assets amongst the litigants in 2007 alone. I have also served as Discovery Referee on a number of complex Insurance Coverage and Construction related disputes. I welcome the opportunity to assist the court and counsel in the expeditious resolution of thier disputes. |
