I like to begin facilitatively and to involve the clients. It is often helpful to allow them to speak for themselves, which often has a purgative effect. As the session progresses, I move toward a directive approach if the parties are not making progress. Ultimately, I will not shy from giving my opinion on the likely outcome of trial. It would be a rare occasion when I start a mediation by speaking only to the lawyers and asking them for a settlement figure.

Arbitration varies depending on the case and the parties. In some cases it is quite formal and judicial in nature. In others, the rules of evidnece and presentation of the case are relaxed.
