I almost always begin a mediation using a facilitative approach. I tend to remain in that mode until I think it would be more successful to switch to a directive approach.
Arbitration

I treat arbitration as if it were a judical proceeding. However, when appropriate, I will allow offers of proof to expedite a proceeding, with consent of counsel.
