My approach as a judicial arbitrator is to allow the parties to try their case. I typically conduct the hearings in a conference room in the courthouse. I ask to receive the briefs the day before the hearing. I discuss the case with counsel at the beginning of the hearing to determine if there are any stipulations and to alert me to the pertinent issues. I issue an award which I believe reflects what a San Mateo County jury is likely to decide based upon the law and facts presented at the arbitration hearing. |
