Arbitration was originally used to arrive at quick resolution of business disputes that otherwise would prevent the flow of commerce if dragged out for litigation. This approach has been modified in recent years to allow in certain cases for discovery and certain legal procedures for motions in arbitration and for rules of evidence. We need to keep in mind the original purpose of arbitration and not make it overly formalistic. |
